Estate Agents Bill

Does anybody know whether the above Bill has been passed and whether it's possible to get a copy?

It's regarding legislation to protect expats to stop deception and extortion from unscrupulous developers in the trnc, which I am sure, we are not the only ones.
All the information and assistance will contribute those in a similar predicament.

I would hope that the proposed legislation covers the Cypriots as well, they are also subjected to deception and extortion and suffer the same fate as many expats do.
No matter how hard the past, you can always begin again.

I'm sure it will be for everyone, but I'm not aware if it has been implemented. Stuck in an intray possibly.

waddo, true. However, Cypriots have the option of voting out corrupt political parties in the hope the situation will improve for them. Expats do not enjoy that privilege. I fear, though, the whole property business structure is rotten to the core and those making the money will use their influence to resist any change which detracts from their profits.

They don't though - what they do is vote in their own, friendly, corrupt politicians, so that they can 'get things done' with a nod and a wink...

I remember the newly introduced law, requiring buyers to register their contracts. This was suppose to prevent memorandums being placed on sold properties. Was it effective? Absolutely not. If anything there has been an increase in auctioned properties due to developer loans. I wouldn't hold my breath that any new law introduced in the TRNC will safeguard a property purchase. As Keith correctly states it is more about cronyism and nepotism than laws.

Keith, whatever they do or don't vote for, they have that choice. We don't and have to accept the corruption to the elite's advantage - or we pack up and depart.

"Not our problem" maybe not, but the outcome affects most of us. If this"Bill" gets passed, it will be to the benefit of all those who have been/are subject to those unscrupulous developers deception and extortion which needs to be stopped. I'm aware that there numerous people who have paid full purchase prices for their properties, have yet to receive their kocans/deeds, and the developer is demanding more money for extras. These people are suffering because of this deception and it needs to be turned around for their benefit.

btw, everbody has

This has gone off topic. The question was whether anybody had knowledge of if the"Estate Agents Bill" had been passed, or if it had been delayed and what is the current situation.
Sorry to be blunt, but it is very important to those who have been deceived to unscrupulous developers.

CT (02/10) published a story about some regulations going through the legislative mill to give effect to the so called "Gary Robb Citizenship Law". Maybe this is what you have heard about. Will it help? No.

The Estate Agents bill has been introduced. As usual it is a very ineffective law merely asking that all Estate Agents are registered. This was taken from the web site of a TRNC Estate Agent.

"According to the new estate agency law, all established estate agencies must be registered and obtain a license from the Interior Minister to be eligible to sell properties in North Cyprus. Buying through a registered Estate Agent will give you complete peace of mind, therefore, for your own safety, please stay away from the unregistered estate agents, or any other people who claim to be marketing properties"

I would have felt more confident if many of the Estate Agents that have been involved in unscrupulous. illegal activity had been refused registration. There has been no improvements in conveyancing laws and no matter how many have been amended they still do not safeguard the buyer.

Lavender, that extract seems to refer to the Estate Agents Law of 2007 which introduced regulation of agents and registration of contracts. Since then successive governments have refused to implement any laws to protect buyers or to enable contracts to be enforced.

Not sure about that. If you go onto the Home Buyers Pressure Group site, it is there, I don't know how to load it onto here. It shows the date of 2013, but I'm not sure if it's been passed by the government. That's what we need to know.

Tojo, based upon the legal opinion I received from my advocate last year, "there is no law in the TRNC which demands that the owner of land must pass on that kocan (deed) to a new owner of property on that land, even with a legally binding contract stating that there will be no encumbrance on the land."

I was proposing to sue my developer but was advised even if I won the breach of contract action, I would still not get the kocan because the judge could not enforce a law which doesn't exist here.

Using the link in the link(!) provided by Kerry, and selecting "E" for "Emlak" (~ estate agent), I found this page - go to page 2, and toward the bottom there is "38/2007 Emlakçıların Kayıt ve İşlemleri Yasası" - clicking on the .doc link provided a word document which appears (via google translation) to be something about registration/regulation of estate agents - don't know whether it's of any use....?
