Memorandums on Property

We live in our property and have done so for a number of years, we have yet to receive our Deeds/Kocan. Can anybody explain how Memorandums work and whether it is possible to prevent the builder/developer placing one on our property?

If you register your contract at the Land Registry they should notify you if anybody tries to put a charge on it.

We have registered our property at the Land Registry some years ago. Does that mean a Memorandum cannot be placed on it?

In theory yes-but some purchasers have registered their contract only to find later that the builder/developer or bank has placed a memorandum on their property or land.This is rare but it does happen.

With regards to Parcilisation please be aware that this will not be granted if there are any outstanding authority bills to be paid.This covers outstanding bills to the municiplyepality,government offices ect.

Tojo why don't you visit the Land Registry & enquire they are very helpful, take a copy of your contract & the registration receipt. Best to go after lunch as they are very busy in the mornings with transfers, they do not do them in the afternoon.

Art. not strictly true. It can be argued that when you receive the deeds from date of receiving deeds then you start paying municipal bills, any previous outstanding bills belongs to the original owner/developer

My aplogies I was only refering to previous bills which the landowner /developer/builder is responsible to pay.

My developer owes the local municipality some money and if this is not paid we will not get the site parcilised.

This is my understanding of the situation.
