Parcellisation and title deeds

After eight years our developer has not parcelised our site or transferred title deeds to us. Many owners wish to pay for the parcellisation
to be done themselves, we realise that this has to be done as a whole site and not individual properties. We have eight none payers, who do not subscribe to site fees, they will probably owe council and property tax as well. Can someone who has gone through this process explain which bills need to be up to date before the process of parcellisation can begin?
Before we received the keys to our properties, we had to pay our KDV, we only have a receipt from the developer for this and we do not think this money has been paid to the tax office by our developer. When does the KDV money have to be paid, before parcellisation begins or at the transfer of deeds?
Any advice will be greatly appreciated.

You will need the original Kocan & the green file that contains all the plans & visas (building permits). All applications have to be made in the landowner's name so they must be available to sign documents or give someone POA. All Property Taxes have to be up to date & receipts available. The KDV receipts do not have to be shown until transfer.
You will need to employ someone to do this for you & be prepared to keep paying out over many years for new plans, new permits, new taxes & of course backhanders. It is not for the faint hearted or those with no funds.
None of the departments i.e. Land Registry, Belediyesi & Planning work together it depends who you see & how they feel on the day - good luck you will certainly need it!

Hi sorry cannot help you with that. Forgot to mention also that if your builder is not the same person as your architect you will need to employ the architect to modify or prepare new drawings. Once plans have been drawn they cannot be taken over or amended by anyone other than the original architect unless they give their written permission which of course is never forthcoming. You are a licence for them to print more money however incompetent their original drawings were!
You must have the cooperation of your landowner & architect to enable you to proceed unfortunately.

Have you tried to get a shared kocan? If there are people not prepared to pay then you will have problems in getting parcelised, you will have to pay all outstanding taxes to belediyse if they have not paid. That is just for starters. We have shared kocan as there is no chance in this century pf getting parcelised, and there are only 6 homes on our site.
Have you tried talking to Marian Stokes she will give you all the answers to the questions you ask, in fact many answers will be found here -

Thank you all for your replies, I think our site is a bit different to the norm. The landowners were the builders but the developers who designed the site and sold the properties are a different company. They were given power of attorney by the landowners to do this and it is the developer who will not do the parcellisation and transfer title to us. I will go and see Marion Stokes on Tuesday to try and get further information.
