Me too please Tom,
flowerfairy68@hotmail.com
Also, can anyone clarify that if you have lodged a will with an avocate, they are entitled to
take a percentage of your estate?
I've heard some horrifying stories, of course most of them could be ''Cyprus whispers??

FF have a look here,
http://citizens-advice-cyprus.com/wills.php there is an "option" to give the executors a "share" of the estate, I am sure this has been been abused.

Just for info, when we did our Wills a few years back, I was told that only a lawyer could be executor, so of course we did it through the lawyer. £100 each for a computer print out! When I asked how much to be executor I was told £1000. Of course that was not written down anywhere, so by the time we snuff it , it could be far more. And all that was to handle was the house! Ouch!
So do ask any lawyer before you go to them as to what it will cost.
If the law has changed and anyone can be executor, then please tell us, as I am thinking of re-doing our will anyway.

Went to a talk at the mountain View Hotel yesterday, given by Chris Arif, a Paralegal who is one of the Directors at 'Citizens Advice Cyprus' - very illuminating! It appears that if you appoint a solicitor to be your Executor, some insert a clause that gives them a 'percentage' of the Estate. The percentage is not stipulated and can be a significant portion of the Estate! As you have signed and had the Will witnessed, it is quite legal.
The 'Citizens Advice Cyprus' office is on the Bellapais Road - go up towards Bellapais, turn right at the roundabout (just past Cheshire Homes) and the office is a few hundred yards up the road on the right. Well worth a visit to get the true facts about various issues. It is recommended that you make an appointment first (free, but you can make a donation, or sign up for a year for £50 and all help is free during that year).
Tel: 0392 815 0733, email:
chris@citizensadvicecyprus.com
Hope this helps.

I recall a couple of years ago that to make and lodge your own will you had to go to the Post office and buy some stamps and then lodge in some building behind the hospital and you could only do this on a Tuesday or Thursday I know this is a bit vague but could anybody tell me if this is still possible and what are the costs and where exactly do you have to lodge the will
Thanks

A solicitor is not required to make a will here. That being said if your estate is likely to be complicated, legal advise might be worth seeking. Having used your template and make sure that all is just as you want it, then you simply "lodge" the will with the court next to the post office in Girne. You need to take stamps with you and two witnesses and the clerk to the court, very nice lady, will put your will in an official envelope and issue you with a receipt. You will of course have probably made photocopies for your own information. I think as someone stated before that only certain times and days are given to this activity, so call in and ask. It is the door slightly to the right of centre when facing the front of the court building.

We certainly did not take our two witnesses with us when we registered two wills at Girne Court. Our advocate was with us. We went up the stairs to the balcony turned right along a short passage and it was the last door on the left. Very helpful Registrar with excellent English and a good sense of humour. Cost of stamps has gone up I suspect, so anybody registering wills will need to ascertain current cost of stamp and registration plus days and timings of opening of this office. Probably the easiest, in terms of process and execution, of any legal/Governmental dealings in the TRNC in our 5+ years here.

Regarding lodging your own will. I went to the court last year as executor for a friend and it was necessary to make an appointment first. The executor and witnesses had to be present. We were advised of the stamps required - something like about 40TL I seem to recall - and went along to the Post Office to get them. The registrar had a look at the will and then got everybody to sign - passports/kimlik cards needed by the way. One copy of the will is put in an envelope by the registrar, sealed with wax and deposited in the court safe. A receipt is given for the will.

Hi,Thank you so much for that-it will save us a lot of money.
No-not the area near Sutton-the one near Wallsend-Tyne and Wear. Apparently there's a Rosehill in Istanbul-Gul Tepe?
A long time ago-but I've always kept the name as I have fond memories of living there.
Cheers

But many thanks anyway, I'm sure you've helped a good many folk with this.

Any adult person can be an executor, not just advocates. That has always been the case!
It could well be wiser not to use an advocate even if the deceased person's affairs are complicated, because one can be hired to help with the winding up if the need be. You then have control. It is not that difficult to do a probate yourself, especially with help from the CAC, and you would save yourself from predatory legal costs.
It is not obligatory to lodge a will with the Registrar but it is probably sensible as the validity of the Will is checked. It would be too late, after your death, to discover that the Will was invalid.

Is it necessary for the Executor of the will to be present when the will is being lodged.
