Anyone know if is possible to change ownership of our property to our son as we do not have kocan{9 years waiting} please?

What makes you think that your son would be able to get kocan if you can't? It can easily be changed into your son's name but would involve legal costs and taxes. Expensive if there is no guarantee he will get title deeds.

So are looking to have your sons name put on the original sales contract? Then ask your lawyer to do an adddition and get it signed by the original builder/seller.

...and if your builder is a "very, very nice man", he may not even charge you very much for the privilege!

Otherwise, he will probably want up to £2,000 for giving his consent, and adding his signature to the document...

The builder is the problem why we STILL have not got the KOCAN.

Then I don't see a way to put in your sons name, as the only legal document you have is the sales contract. Any changes would have to be to that, I'm afraid,

It may be worth waiting until the proposed settlement has been concluded one way or another before you do anything with your claim.
There may be a completely different outcome for people with property in the North after the talks have finished ?

Is the builder never going to sort out the Kocan?
9 years would be considered quick for TRNC, I'm into my 13 year with a not to bad builder (no mortages etc) although I have a Kocan for the land (5 years ) so consider myself fortunate.

Just a question,... Why would a builder grant the Kochan for the land but not the building ?

It's a relatively quick, easy and inexpensive procedure, that's why!

To get a house put on a Koçan is a different proposition entirely - and costs a bomb!

From the builder's point of view (not that I sympathise with the builder, just so that you can see the motivation...) - he's already had all the money that he's going to get out of the purchaser, why on earth (apart from little things like Contracts, Conscience, Morals ) should he spend any more of his own money? Unless of course, he can coerce the purchaser into paying all his fees and taxes, plus a bit of a back-hander to make it worth his while...

Don't forget that most of these 'builders' were not builders at all before the property boom around the turn of the Century, they just saw an opportunity to make a quick buck, and "After all", they thought, "How difficult can it be to build a house? - you just do a deal with someone who has a spare bit of land lying about, employ some cheap labour (Kurds), hire a concrete mixer, and off you go!".

The week before that, they were living in a hut, and using a leaf to wipe their A**E

I still can't believe that we (all?) got off the plane, and agreed to buy houses on their terms, you know, pay now, get the house later, maybe, and get the deeds sometime / never, when we were well versed in the UK house purchase procedure, of putting down a small deposit, and then not parting with another penny until your own solicitor was handed the deeds by the other party's solicitor.

The builder has a kocan for some land on which he builds a couple of houses he then sells the properties, the solicitors then arrange to transfer the kocan into the our name taking 5 years to do it, we leave office very happy totaly unaware this is just land Kocan.
Beli accept our offer to pay property tax etc not mentioning the kocan is for land only , years pass we become aware through neighbours we need to have property on kochan.
Has swallows it was impossible to get anything done despite promises and numerous phone calls. years pass eventually surveyor measure boundry .
Now resident here loads of calls at local rates! Many visits to Tapu we now have a shared Kocan with property on, waiting for new neighbours so we can complete the process, we think!

David, it's actually not such a big deal, really...

If you own the land (your name on the Koçan) then you own everything on it, house included.

A lot of locals build houses on their plots, and never bother with all the hassle and expense of putting the house on the Koçan!

Don't lose sleep over it.

DAVID, wish we had met you before we got involved with our bunch of crooks!! Like idiots who had been brought up in the UK, we believed that we should own property rather than pay out good money in the form of rent, We have learned our lesson the very, very, very hard way and its still costing us tens of thousands after nearly 11 years. I'm sure people who have bought in the last 5 years or so believed their problems will have been solved and everything is straight forward now but NOOOOOO they are still well and truly alive and kicking ,so be prepared to accept you will never get your full Title Deeds without paying megabucks in brown paper envelopes!!

Renting seems fine in the short term always worried about my home being sold from under me.
Wasn't there a issuse about renters having difficulties with residency applications
