Land search

Can anyone tell me , what is needed to do a search on a site to see who has and hasn't got contracts, trip to the land registry, with Kocan, what else

Take your Kocan and passport with I think it was about 15tl to start the process and then you pay a further amount when you uplift the search some days later however it's only the person who's name is on the Kocan who can request a search.

I'm not really sure what you're wanting to do...

If you are talking about a Sale/Purchase contract to buy a house or Apartment, then almost by definition, all the 'owners' will have had to sign a contract, and pay for the property before they are allowed to occupy the Property.

What exactly is the problem that you are trying to solve?

We are on a site , the builder has gone back to turkey! Land owner not interested, there are several buildings in various stages on development, trying to fond out , who has bought and what hasn't, thought first place of call would be land registry, to check sales contracts , not saw exactly what is needed

OK, that's a little clearer...

So you are not trying to find out 'Who' has a contract, you're trying to find out 'which properties' have sales contracts registered against them - yes? - and then, who are the individuals named on the contracts (the purchasers).

I think that you need the help of someone who has contacts in the Land Registry, and who deals with them on an everyday basis - I would suggest that you ring Altan on 0533 851 4658, and explain the situation to him, and tell him what you are trying to achieve.

The Land Registry is a bewildering place if you don't know all of the procedures involved, and don't have a fluent mastery of the Language.

At the end of the day, the biggest obstacle to your gaining legal possession of a property on the site could be the landowner - since the builder has disappeared, the landowner has not, presumably, received his allocation of apartments or whatever that were promised to him as a part of the purchase price for the land (this is more or less 'standard practice' in these sorts of deals), and as the landowner is probably still the legal owner of the land (i.e. named on the Koçan) he is unlikely to be willing to go to the trouble and expense involved in helping you to gain control of a part of that land.

Sorry to sound so negative, and It may not be all that bad, as we don't know all of the ins-and-outs...

Have a word with Altan, and see what he thinks your prospects are.

Did you have sight of the Kocan when you went into sales contract.
Did your advocate advise and did due diligence take place when sales contract was approved?
The Kocan holder owns the land and is king.

What does the sales contract say regarding title, transfer of tile, taxes, obligations of builder and land owner.
Your advocate , if any good should intervene to seek a solution.

Sorry to say this but this type of situation can take a long time and be rather expensive to resolve.

and if in town pop into the noter Unsal next door to the café opposite the courts, he many years ago used to work in the land registry and seems to get information about kocans a lot quicker and easier than most.

I found his description of our boundaries far more revealing than any advocate when we bought our current property and have quoted him when neighbours have tried to abuse the land we have an interest in.

We have bought and sold using him and I have found him very enlightening even though it may not be what you want to hear especially when you personally have done something before consultation.
