Bad tenant - any lawyer recommendations please?

Hi has anyone had positive experience of getting rid of bad tenants please it seems the law bends over backwards to protect them?

If you can agree a deal pay the the tenant to go it will be quicker and cheaper .

I agree about Funda she did work for me although not tenant related. She is like a bulldog wont let go and doesnt stand any nonsense

Thank you I met Funda a while ago & was impressed with her attitude but did not pursue that particular matter with her. We have tried to be conciliatory with the tenant but she will not reply to emails, phone calls or texts let alone answer her door. Her charming boyfriend has threatened to 'hurt us' the situation is a nightmare.

Have they got a valid current registered rental contract (and bear in mind that contracts are sometimes deemed to automatically 'roll over' unless specifically terminated)?

Have you tendered written notice to quit, with some sort of proof of delivery (ie witness, video recording on phone...)

Unpaid rent may be a 'Civil matter' and not necessarily grounds to get them evicted - strangely the detail of the law to be applied may depend on which area the property is situated - bizarre!

The Police might be sympathetic if you can show that you require the premises as the 'Primary Residence' for yourself or for a member of your Family - a friend went through this, and I followed the process closely!

The idea of 'paying them off' (£1,000? - £5,000?) May indeed be the cheapest and most effective method, if you can find a 'third party' to broker the deal, even though you might find it morally repugnant. Legal eviction can take many years and cost a fortune...

Thanks Keith we are fully aware of all these points. If she was paying the rent it would be completely impossible to get her out but she is not therefore she is not classed as a 'legal tenant' not that it seems to make much difference!

We had similar situation. Solicitors quote 2000stg upfront. Before they would even look at it. She went eventually left large electric bill & water cut off. We don't rent out any more!!!

Mimi2 says her tenant eventually left after leaving a large electricity bill and had the water cut off. These days Kibtek seem to cut off electricity after a bill of around 700TL hasn't been paid, is the tenant paying Kibtek direct for electricity or could that be a solution? Also would the water be cut off if left unpaid?

There is another thread re service prices where the tenant seems to be paying the landlord rather than Kibtek for electricity used. I just wonder if the reason is that it makes it easier to let the services be cut off through non payment as the tenant doesn't have the account details/water card to enable payment to be made.

As at last week her Kibtek bill was 1800 tl & water 1200 tl. with no signs of either being cut off! These accounts are in our names.
It is a right for a tenant whether or not they are a 'legal' tenant i.e. still paying rent although contract has expired to have a water & electricity connection

If its in your name you can have it cut off I would think.

I would be worried that, as the bill is in your name, that your own electricity supply at home could be cut off as well...

Recently Santa Fe property occupiers who had left the electricity accounts in Santa Fe's name were threatened with being cut off because of the cumulative amount owed by Santa Fe/occupiers collectively! - It was resolved eventually, but a few blameless occupiers did get cut off.

Sorry to hear about the extent of your situation . Be interested to find out the law on the electric as if they have a rental contract they can connect to the electric . Are you actually breaking the law if you simply close your account and take back your deposit ? They can still connect they just need to pay a deposit.They have played the game on kibtek as you probably know as they only cut off the ekectric if you owe more more than the 479 tl deposit limit from the previous month. Bill. So as long as you dont owe more than 479 tl from the last bill it means month by month they can rack up a bill.

Really difficult situation for you i hope they go soon . Are they tcs ? If not eventually they will need their residency permit renewed but i guess you already have taken account if that . Id heard £2000 was the going rate for a lawyer . Its criminal here how lawyers and architects charge more or at least the same as the uk when all other salaries are so much lower.

I have evicted in the uk before via section 21 and did all the court procedure up to bailiffs myself . That took almost 6 months . My understanding is that the law here is based on uk law . Is it worth investigating if you can do the court application yourself might save you a lot of money and you would be in control of submitting docs and stuff . Its unlikely any advocat will volunteer the info but for a reduced fee the retired advocat opposite the girne court might help.

On the plus side 1800 tl and 1200tl seems like a lot but because of the depreciation its less than £400.
I dont know how much rent they owe but i have had similar acts of agression its what some people do when they get in a hole .i fought back and fortunately they left. If it was me id seriously consider going to kibtek and closing the account. You might find the tenants having had a free ride might simply dissappear into the night . They probably dont have the money to engage a lawyer. I have no idea of the ramfications and potential cost of such action but it would be at the top of my list for all you know they coukd hve a plan to leave soon anyway . I have heard its what a few letting agents do . Id also be going to the water hq and have a “friendly chat “ with them they might have not realised the extent if the arrears on this acoount and make the decision to cut the supply .
