Site maintenance

Hi everyone. Just a quick question. We are a small site,14 villas .we have 4 villa owners who refuse to pay the maintenance fees (£500) per year. Yet they use all the facilities. Do not pay towards site electricity, site council tax, delivery of tanker water .just because they all have their kocans, think this is ok. Surely this is not legal. Any advice would be appreciated. Thanks in advance.

This is a very emotive subject and a common situation which occurs on most sites large and small here. How to deal with this problem depends upon many differing factors. It would also help your situation if you have a formed committee registered with the Tapu Office. Every owner has the right to take direct legal action against those co-owners who do not pay. However, the best advice which can be given is for those 10 paying owners of your group to seek the advice of a lawyer who can navigate you through this situation. You may wish to know that being in possession of a Kocan offers no protection for those non-paying owners, which they think, allows them the privilege to avoid making payments towards the upkeep of their site. I personally can recommend Naomi Mehmet on this subject.

I had two friends with the same problem, but in their case it both was Turkish and other foreigners who were sort of swallows and categorically refused to pay up as they did not actually use the facilities for a lot of the year. The developer was Turkish and he did not force the issue and didn't seem to care as long as the other paid up.. (i.e. people like yourself) I don't know the final result though.

Whether you used it or not, you should pay!!

It's a condition of buying on a site but unfortunately not enforced.
