Registering a committee at the Tapu Office
Can anyone explain to me the rules for registering a committee at the Tapu office and the advantages and disadvantages of doing this.

It would appear from the no response that you may well have to seek the advice of an advocate or ask within the Tapu office covering the geographical area in question.

According to Cyprus Today the laws are to change to ease the problems registering Associations. This could make your task simpler and one wonders if it is worth waiting for any changes. Of course, this being Cyprus, you could be waiting a long time.
The alternative is to perhaps get in touch with the BRS, ATA RBL or one of the other established bodies who must be doing this on a yearly basis.

Thanks for your replies, perhaps if I said it is our complex (where we live) committee and not a big association that I am talking about, then maybe I would get more information. I have been told that to make the committee legal one must register it with the Tapu Office.

We looked into this a while back and having a legal practice owner on our committee we were informed that, first evey property owner on the complex has to have thier individual title deed before a legal committee can be registered.
As a legalised committee has certain powers it must be elected in such a way that there is fair and even representation.
The whole complex must agree to a legalised committee and the election of the committee must be conducted as per the government guidelines for electing a legalised committee at that time the guidelines had not been formalised.
We did not continue as 40% refused a legalised committee when they found out just what powers a legalised committe has especially when it opened doors to prosecute non fee payers and get memorandums placed on properties plus being able to make complex rules etc that were binding etc.
Don't know how it progressed but that is what we were informed 2 years ago.

As one of the reasons for wanting to form an association, on our development, would be to attempt to collectively ease the developer towards completing the parcelisatron process, and giving us either shared, or individual, deeds, it would be a real sickener if we were unable to legally form an association, due to not having title deeds.

I am sure there is a difference between legalising a committee and forming an association.

The reason I asked this question to begin with, is because we have a few non payers on our site and we are sure there is no legal way we can make them pay unless we are a registered committee. Where would I get the information from, that states what the rules are regarding the committee and non payers?

the butlers wife - why not ask an advocate specialising in this area? So far the replies above relate to historical opinion/facts at that time. Few expat users will know the current, definite answer (in law), despite our views, on non-payers, late-payers, swallows, failing local maintenance providers et al. Once you have a response, it could be included within the 'legal' section for all to view.
