K5 HOUSES FOR SALE
Yesterday an appeal to prevent selling off K5 property before the completion of the trial was rejected by Girne district Court Judge Taner. Earlier the same Judge had made a decision (some time ago) saying virtually the same thing. He expressed the view that selling on the properties would cause no irreparable harm to the house buyers because if the final judgement was in their favour no irrreparable damage would be done as the Akfinans Bank would compensate them. (OK - WHY BOTHER PUTTING THEM UP FOR SALE THEN, JUST LET THEM LIVE IN THEM??? COMPENSATE THEM - WHO'S BEING A JOKER??) As a direct result of this ruling yesterday, today, on a public holiday, Akfinans Bank have erected For Sale notices on some of the K5 properties. Can you imagine how that feels.
What can WE do? It is said that some of the Legal profession are also various banks directors, I cannot comment on that, but........
Apart from all of us leaving the country en masse (and also leaving some very nice valuable properties behind) to let it struggle on without our monetary and charitable input, what can we do? I cant see anyone getting anywhere very fast. Any ideas?

How sad but typical. All we can do is try and dissuade any one else from purchasing these properties so the bank can't sell them
As I got older I congratulated myself on my tolerance..... Now I realise I just don't give a "ooops"

Hi Mamachina, just read your topic and felt my stomach sink thinking about those for sale signs going up, those poor owners must feel so helpless as Im sure we all do, (there but for the grace of God etc) theyve tried so hard but I fear fighting a losing battle all along. It probably wont be the first or last either. We love our holiday home in Cyprus but if we knew then what we know now Im sure we would never have comitted ourselves as we feel nothing is going to change any time soon on the island and we know we are lucky as some of these people have lost everything and cant move on, my heart goes out to them and hope they find some peace.

The irony of all this is there is another case on going where the K5 people are trying to get a decision to say the original auction was illegal.
Now,in my tiny mind I would assume that the case regarding the auction should be decided on before there is any attempt made to sell the properties. Imagine the greedy illigitimates at Akfinans manage to sell the properties and evict the rightful owners. Then another judge decides the original auction is illegal, what happens to the original buyers? Well the judge in the case about selling the houses has given a decision and upheld his own appeal (MMMmmmm) that the houses can be sold.
Maybe one of our legal eagles can tell us if this scenario would prevail in the UK or elsewhere? Whatever the Kader family who own Akfinans have a lot to answer to and it looks like the answer to nobody in TRNC.

Is this the SAME Justice Taner that chaired the Disciplinary Committee at Cheshire Homes over the Festival 11 problems (? whitewash )and issued what many Expats considered an arrogant and condescending statement to Cyprus Today re the numerous complaints.
If so , the issued judgement IMHO is par for his course.

I thought Taner was retired. By the way i was sent the same statement to put in Cyprus Star, but felt it was badly worded and did not really reflect the Taner that I knew. (language can kill or cure). But how could anyone allow these properties to be put up for sale with outstanding court cases. It is all just too illogical for words, and WHO would buy them? Or are these for sale boards just to make a point. Unless the Banks buy them, surely no self respecting purchaser form here or elsewhere would touch them, and what happens when they consult a lawyer here to act on their behalf. 'Sucks' is a word that comes ot mind.

It is Judge Talat on this case, I do not know who is on second case.
Marion, I believe it is largely scare tactics but are the people involved going to be scared off after such a long fight? Would be interesting to know if there are sale notices in any estate agents or press. Given the overall attitude of the Kader family it would be no surprise that they have contacts who would buy regardeless of the rightful owners.
Obviosuly too late for this week but how about you do a story with the latest facts with photos next week Marion. Or would photos be censored?

The news came too late for us (Star) this week, and I am hoping to do something , but as you say, i am sure that there are people lined up to buy those properties direct from the bank! But one can never prove it. It is as someone said 'There is no justice in TRNC' but for me, there culd be worse things such as rape, killing, land mines etc. that doesn 't mean that wrongs should not be put right! I don't think photos would be censored, but did you know that the Star media group has already paid a fine of 10,000tl in connection with this. I am not sure whether it was TV (I( think it was), but this is the first libel/slander case I have heard of. Scare tactics! yes indeed, but I would be terrified and I am not a scarey type. I would be terrified for my husband, for our future, ........ Poor Lindea Orams did not do well at all and I believe she has had cancer, which is often brought on by stress.
Such a shame that these ugly events car mar the beauty of this place, but then life is always ying and yang. wish it was ony one.
Someone said the K5 should tear thenotices down, but that culd create further problems for the residents, so best left, I reckon. One thing I have not ascertained is who one should contact to purchase.
But if I win the Lotto this week, I will buy them all and give them back to the current residents.

Are you saying that you decided not to print the Official Statement issued by Girne Rehabiliation Centre/Cheshire homes purely on the above grounds or was there editorial input into the decision not to publish ?
