Builders tax - where can i get info ?
Our site is trying to get final parcelisation and it seems as if the builder didn't pay his tax on some of the properties. Where can we go to find out which houses are unpaid and how much is owed ? We want to find out before carrying on.
We have been told that the parcelisation and having the houses registered/shown on the individual title deeds can still go ahead but we are not sure if this is correct.
Can anyone explain the process (in simple terms ) please.

The yearly Belediye property tax on all the properties will have to have been paid before any procedures will be carried out by the various Govt departments. You need to get a copy of this from all your neighbours so that it can go in the file so if say there are 5 properties on your site you will need to show 5 receipts (you did say make it simple!). You can then see which ones are missing & then go & check with the relevant Belediye eg for Girne area it is the one near the Police they may help you identify the missing ones or they are probably still in the name of the builder.

Are you talking about the stoppage tax or in English the capital gains tax as this is completely different from property tax?

Sorry ozonkoy but the question was builders tax. Our developer has never paid the property tax and we are still waiting for parcelisation 10 years after buying. All the owners on our site have paid the property tax since receiving their keys.
I agree the best place to go to for the correct information is the CAB and Pembe Ibrihim will be able to help you.

You can find out from the Land Registry, the building with the desk for car tax. The land registry bit is further over in the middle of the room. They can tell you if your builder has paid their share, and if there are any other outstanding taxes. It will all have to be settled when the Kocan are available for you. You need to pay the annual property tax whether you have the Kocan or not, and it will be back dated, I think ours was back dated to around the time of the contract. That has to be paid in full in order for you to get the Kocan. But, as said by others Pembe at Citizens advice will know.

Hi - i think it is the same as thebutlerswife says. We too have all paid our beldere property anual tax - so it must be the stoppage one. We paid a % and the builder was supposed to pay a %.
We are a site of 7. Our shared "kocan" varies from villa to villa (should say plot to plot). We were the 1st to receive ours and it names the builder owning 6/7 (in sq mtrs) and then our name as 1/7. Another 2 owners have the same but showing their names. 1 other (recently purchased a resale) has not got their name on. 1 other owner has not yet received their "shared kocan" and the other 2 i am not sure of. Everyone is agreed that we all want final parcelisation. But the builder will not complete it - he say "I haven't paid the tax - have no money so i am not doing it".
We have been told it can still go ahead and his unpaid tax is a separate issue that is specific to the transfer of the title deeds which can be sorted after parcelisation.
But if our "Shared kocan" has our name on it does that mean that he did pay the tax on ours and the others with their names on ?????
Then we were told if you take on the parcelisation then you (owners) will be responsible for his (builder) unpaid tax yourselves.
We obviously want to know which houses (if any) he paid tax on and how much is outstanding on the others.
Its a minefield trying to find out.

Good luck Sally4670, we were lucky in that when we came to transfer the kocan and checked everything, the builder had paid all his taxes, unfortunately the git of a landowner who actually had to sign the transfer, held us to ransom for a further £5,000 before he would sign it over. He did the same to two others on our small site. He lives next door, needless to say he is now Billy no Mates, Robbin B*****d! Unfortunately, these things can happen just as you think everything is sorted....the contract was worthless!...But that's another story.

If the Kocan has your name on it, it means that the builder has paid his Stoppaj (Sales Tax) on your portion of the land.
The Stoppaj is not due until he transfers from his name into a purchaser's name therefore the fact that not all the plots have been transferred makes no difference to the parcelisation/final approval process.

I don't wish to complicate things even further but did you pay VAT to your builder and did you get an official receipt for this?
We paid 75% of our VAT to our developer when we bought and we know that this hasn't been passed to the tax office yet.
Could your builder possibly mean this tax?

The poster has their Kocan so the VAT has been paid.
Stoppaj, KDV, Purchase Tax & Municipality Tax all has to be paid on or before transfer.
Transfer will not take place if the Vendor owes tax as he is not allowed to dispose of any assets in his name, despite the fact that they have been sold to someone else but that is not the issue here.
As said before the parcelisation & Final Approval procedures are nothing to do with tax.

I do not understand why TBW is directing posts at me, I am just trying to put on as much information as I can if it is not relevant then discount it.
I do not know any details of this site but all I am saying is that the parcelisation & final approval processes are nothing to do with Stoppaj Tax & whether the Kocans are still in the builder's name or been transferred to the Purchaser.
