We have been trying to obtain the shared deeds for our Kofali apartment for the last 3 years, we are aware they are available however every time our Advocate makes arrangements for Mr Kofali to attend the Land Registry Office he fails to attend. At one stage we had a buyer for the apartment and even offered to pay Kofali's Capital Gains Tax in order that he would allow the transfer but again no. Has anyone else had issues with Kofali and if so how did you get him to complete the transfer.

I am sorry for your problems, he the builder must pay all the taxes to enable the owners to claim their KOCAN. This cannot be paid Individually.
The problem is the builders tax. Most builders today include this tax in the purchase fee but do not pay that fee to the Government, so you have to have all the Occupant willing to pay again this tax to the Government.

The Capital Gains tax for the whole site does not have to be paid in order for you to receive a shared Kocan, they can be done one at a time as it becomes due at point of transfer from his name to yours.
However unless the vendor is up to date with his tax payments generally (not necessarily anything to do with your site) he is unable to transfer any assets from his name.

Many Thanks for the responses, since posting we have visited both the Kofali office and his solicitors office and have confirmed that as he has POA from the landowner it is only Ali Kofali who can sign over the deeds and of course if he doesn't attend the Land Registry Office apart from taking him to court to make him attend, there is little we can do apart from wait and hope that continued visits to his office by us may get the result we are looking for. We just find it very strange that one of the better builders on the Island can get away with this and continue to build and sell.
