Shared Kocan?
Can anyone with experience and knowledge explain the process between two separate owners and properties .
Do you have too work together and share costs ?
What if one won,t play ball?

There is no compulsion on an uncooperative party. The best you can hope for is that they will give you POA to sign any documents on their behalf & you will have to pay all the costs - sorry!

Yes you need parcelisation for the land, architect, mechanical & structural engineering drawings, electrical plans passed by Kibtek, approval from Highways, Telecommunication Department if you have swimming pool plans for that & anything else I may have forgotton! The process is not for the faint hearted & you will need professional help, not a Lawyer.

Depends on your builder. Ours is sorting it out. We just need to pay a few hundred pounds for the telephone line connection ( not that we will be able to get a phone as I understand)

This sounds like my current position; I own an apartment which was similarly described on a site of forty apartments and each owner has a kocan which relates to a one-fortieth of the site. We're now (jointly) in the process of parcelisation, after which each owner will have a kocan relating solely to their own individual apartment. The process has required a full survey of the site to update plans etc from the original construction to include any and all subsequent alterations and additions (such as garden sheds!). All original ('shared') kocans have had to be submitted, and (eventually) new 'individual' kocans will be issued.13roman58 wrote:It states title deeds in owners name vat paid but shared kocan?

Is this property yours or are you thinking of buying it??
If it is yours you should go to your architect/builder as they have started the process otherwise the project would not have been granted permissions. You should obtain the no of the green file & whose name the project is in then you can check the progress yourself. Your first point of call is your local belediye who should have a record.

This is a property that I am considering buying there are 9 and the other 7 have full kocan but this and next door are a shared kocan with ' title deeds in owners name vat paid ' thanks for the help

I don't know if this will help but just so you know, if your property is over 5 years old, as I understand it, you do not have to have the original architect to do the parcelisation work for you; you can shop around for your own architect to do this. We used a guy called Kemal in Alsancak, who was really good and reasonable and he got a list of all costs involved. We too had to have and pay for telephone lines - but altho trenches and manholes were dug, no lines were ever put in but our parcelisation and full Kocans were issued despite this!

If the other 7 have the same builder I would speak to as many of these as you can to find out how they got their Full Kocan. I do not know who has given you this info but you need to verify that it is true, some people think they have full kocan when they have not & some people do not tell the truth.

13roman58, 8 properties in our road, all paid roughly £2,600 (sterling) each - without looking up paperwork this is very rough guide but there were a few incidentals to pay, so that figure covered everything, including the architects fee. We live in Karsiyaka and as said previously, used Kemal Cakmak in Alsancak. BUT all these things vary according to circumstances so I don't think you can use our costs for your purposes. Better of course to get someone like Kemal to check out your properties and then advise you if it is possible and his costs etc. And, most importantly, to get everyone on your 'land' to agree to everything - not always easy!

Sally4670 and others - Kemal 0533 869 88 18. I do not have email add. now. His office is (going towards Girne from Karsiyaka say) right at the Yapi market just before the first Starling (which is on left going that way) - straight up that road and his office is the right on the end of the last block where road junction is. (ie at that point, left to Alsancak post office or right to Lapta village).
I meant also to mention in my previous note that we were very lucky to have Cypriot friends of friends here, who gave us valuable assistance regarding liaising with Kemal - who speaks some English but finer points were easier with their help. So it would be helpful to you if you know of someone who speaks the language willing to go with you and translate.
