A Helping Hand During Difficult Times

Unfortunately, over the past few months we have been approached by several families who have lost a loved one and needed assistance with the deceased's vehicle.

We understand that dealing with probate and sorting out a car is often the last thing anyone wants to think about during such a difficult time. I could be very wrong but was recently informed (albeit by a local) that it is possible to change the name of the owner of the vehicle to a member of the family on the Log Book so that the value of the vehicle is not included in the deceased probate. Obviously the member of the family must be added as a driver on the Insurance so they can use the vehicle when making plans for the funeral etc., It sort of makes sense.

This can be a nightmare of a subject. I was going to change the ownership of vehicle to both myself and husband, but never quite got round to it before he died suddenly. That turned out to be a matter of luck at the time. However, I have no idea of how things would have worked out if the vehicle had been in joint names.

To avoid inheritance tax? Illegal surely.

But the point of including assets for probate is to assess the need for inheritance tax? Being in the midst of dealing with a friend's will and having had to obtain 3 separate POA's from the beneficiary in order to sell a car, I would say that the information you were given is not correct although I don't doubt that it can be done if you know the right people.

I must admit, a great minefield, we had decided on our last holiday to purchase a new car, had I really known the law of the land I would of gambled and put it in my name being younger. If it was not for this post I still would of thought I was right!. A crystal ball would of been good, joint names for 2 weeks!
My thoughts, new plate, won't feel old, low mileage, no lip to put the golf clubs in, joint names if either die we just can't sell.
I have been and asked to see the highest of the high. Yes I was told by the police, car registration and insurance I can drive the car. I then asked if I had an accident, big problem if big collision! I pleaded with the registration department put a no sale on it as its part of Gary's estate, just get me legal.
The court when I tried to apply for probate said I should of asked for insurance to state if one owner was deceased I would be covered. I gather this was a waste of oxygen as the insurance company has never heard of such a thing.
The law of the land is the problem, case of a big collision is all owners of the kocan have to present themselves. Anyone got a shovel?
Probate is the only way, unfortunately a law passed in 2024 does no longer allow you to submit yourself with the help of a noter or advocate.
Being the only item in my and Gary's name it's an expensive way to find out I can not legally drive the car until I have completed.
Before everyone panics most will have an estate, your advocate will apply to the court you may drive the car while probate completes, this takes 10 working days once the paperwork is completed
Luckily I can add his gun which I just handed in as I wasn't doing probate for just that which will hopefully assist with the payment of probate.
I did have POA but living and maybe instead of hanging around the hospital I should of gone and changed the car to my name. I have been advised as it was husband I can not really say oh I didn't know now he's died so the legal route it is
My father's words ring in my ears anything you pay to legalise, get rid of asap and as this was such a large decision to purchase this car I want to keep her, even though I argue with her when she tells me I am not driving to her standard and of course she was named by Gary Arabella!! Temperamental golf buggy is my name for her!!!

Probate submitted on Thursday, 15 working days hopefully I will have the cars registered in my name.

Not for any tax avoidance reason but so she/he can use the car. Does that make them the new legal owner? They are named driver on my policy at present. From what I gathered it is a minefield, I decided to apply to the court via an advocate as advised I could not do it myself. I will then be able to register the vehicles in my name and take out a new insurance policy in my name. As we all know the kocan owner has to have the policy in their name with named drivers if you wish.
The cars in joint names have been "garaged" as I was advised if I had a collision "we" could not present ourselves to the police station.
