Selling a villa without an Estate Agent

Easy peasy ..
Find yourself a buyer ..
Go to a solicitor, who will draft out a contract of sale ..
Get a cheque from the buyer, fly off into the sunset ..
That is how we bought our house ..

Same here its the buyer who needs a lawyer the seller doesnt really need one.

you dont need an estate agent,also,if anything is owed on your villa the deeds office wont accept it until those debts are paid off,this includes any outstanding council tax

thats assuming your villa has got deeds,anyone buying a villa without deeds is a bit daft,

Sorry to spoil the party but as someone who (almost) sold a house very recently without using an estate agent, I know for sure that one would need to get an evaluation from the land registry (i.e. the value of the property) which may take couple of weeks, pay for and obtain many documents from the Municipality, from Tax Office ("stopaj"), supply various documents such as copies of IDs/passports, deeds, & a power of attorney if a solicitor is to act on ones behalf, and have all the documentation filled up for the land registry, for final transfer of deeds at the time of payment.

One can do all these things in a few days if they follow the process in the right order. Some estate agents do prepare all the paperwork and do the necessary with the tax office and/or the land registry. That would leave the buyer's bank and solicitors deal with the rest at the land registry 2when the sale is actually realised.

If you are not using an estate agent and use a solicitor, the solicitors would then have to complete the paperwork anyway - in which case there may not be that much of a difference between an estate agent's commission and the solicitors fees!

I would suggest you go and ask the land registry to give you a list of documents required for the sale of a house. It would involve getting an evaluation done, going and paying the property tax and/or getting an invoice showing there are no outstanding payments up to current year, going to tax office and paying the duty tax on the property - unless you are exempt (if you are selling a property for the first time) in which case you need an exemption certificate from the tax office anyway, arranging with the buyers solicitors and the bank for a date when all can be present at the land registry, and making sure the land registry has all forms filled up and in their hands including copies of deeds, IDs, Tax office and Municipality invoices etc.

Unless things have changed in the last 6 months it is not possible to sell without using an estate agent if the value of the property is in excess of a certain sum (I remember only that it was a high figure something like £300,000 perhaps) but evidently it is detailed in the legislation to which estate agents must conform. When I sold not using an estate agent I agreed a figure to be paid by the purchaser and insisted that all charges raised, envisaged or otherwise, were to be met by the purchaser as agreed in the contract. It is necessary for the vendor to give power of attorney to the purchasers solicitor or appoint an independent one so that the names can be changed on the deeds in due course bearing in mind that the purchaser can not have names added until he has PTP (assuming the purchaser is a foreigner). This could be months, or years, later notwithstanding that the vendor is paid on signing contract and giving physical possession of the property and deeds. The power of attorney document is signed and filed in the Turkish language and what purports to be an accurate translation into English is given to the vendor. Squeaky bum time arrives when you have to agree that you accept that in the event of any subsequent dispute between the parties or government offices jurisdiction is with the courts of the TRNC when the documentation in Turkish will prevail. Best to get the monies to a UK bank then spend it or hide it where it can never be found !

The buyers solicitor did all those things when I sold my house privately last year I provided the local tax receipt and collected my money they paid for everything.It was £1000 in fees.I have since bought another property and used the same solicitor she is fabulous I have the kocan already.

It is possible to sell without an Estate Agent, and also without a Solicitor. We have both sold and bought using a Notary, who drew up contracts and sales documents also Power of Attorney letters where necessary and once the PTP was through, also helped complete the transfer of title form, issued by the Land Registry. It is also essential to have Tax Paid receipts up to date.

Here, here! Go on Deniz - no one will accuse you of advertising when you share useful info as such, so please let us know of your solicitors name. I am personally finding it very difficult to find an honest solicitor who will not "pussy-foot" and is not out to bleed you dry! Then again, with the number of solicitors available in TRNC nowadays (must be the highest percentage of population anywhere in Europe) who is to blame them!
