Covering an outside terrace & property tax question

I want to put a tiled roof over an outside terrace which is attached to my villa.
It will be open at the sides.
Does this increase the area of my villa for property tax purposes or not?
I have heard various opinions.
Does anyone know for certain?
I have not yet received my PTP by the way.

With regard to both your tax questions. Is your villa a new build? Is it on the Kocan?

In my experience you should be able to pay the tax just on the Kocan number. If you are new build make sure you have the final permissions before making any alterations, I am told they can get a bit tricky with anything that is not on the plan.

As I understand it when you are ready to pay the tax the area will be all that is covered. The fact that the sides are open is still considered covered.

I have had work done to my property, after they had been to measure to get the Kocan ready. For some reason they have been again to do measurements even though it had been done 6 months ago. I don't understand why they would need to come again but there you go. I am concerned now that I will have a problem because of the additions I have made. Does anyone know what the implications are? Worst case scenario would be having to take it all down........

We are awaiting final approval but this is awaiting a measurement etc from the Tapu. It was inspected by the district land office last year, but it seems you need both offices to measure and pass the property.
Any area where you can not see they sky that is covered by a fixed roof counts as covered area and is liable to property tax - so if you tile a terrace and are then inspected, you will not get final approval as the submitted plans will not match your current covered area.
Sheds and outbuildings not fixed to the ground do not count as covered area

Philoz.

If you have your Kocan, just build the roof.
If not do not build until you have your Kocan.

I have never known the Tapu to reinspect after the Kocan has been issued.
On the other hand I hope you get along with the neighbours as they could dob you in to the Tapu for putting the roof on.

Thanks MVP, any ideas on a gazebo in the garden....with a tiled roof but detached from the house?

To repeat: if you don't have your Kojan don't make any changes as when your property is inspected for issuing the Kojan it must comply with the original plans anything not on the plans will be ordered to be removed.
If you have your Kojan and want to change anything just go and ask your Beyledie if it's OK, as they can tell you to remove any changes after the Kojan is issued, if there is a complaint.
Because of the way things work here if you get permission to make the changes it wont effect what you pay as that's a different department and you would have to go and tell them of the changes, usually if you do you'll get a Cyprus shrug.

Why oh why can some one who has this query just get the appropriate information in black white from the local council they reside in. Why is it so difficult for this sort of planning enquiry for direct information not be available ?????

My understanding is that your gazebo would fall foul.

There seems to be some confussion on the thread re kocans.
You can get a kocan for just your land, but to get your house on the kocan you need final approval which involves the two inspections etc

I put a structure (gazebo type) up on my roof terrace 4 years ago and there have been no problems, but I do have my Kojan for the building. Across from us someone put up some gates (which were pretty awful) and there was a complaint and the Beyledie gave them one week to remove them as they had not got permission to put them up, they came down the next day, never to be seen again.

This is a long story cut short. We have our Kocan, we wanted a gazebo built and asked Meteray Carpenters to inquire with the powers that be if we needed planning permission. They were told no, as long as its 3 metres away from next door which it was going to be. Construction began and whilst my tiler was laying some floor tiles, 2 guys approached him and I and said that complaints had been put in and that we had to cease immediately all the building work. Like I said long story short, I have been told by the council planning dept that I can build the rest of the construction but if I put a roof on it I need planning permission. So they allowed me to carry on building the floor and even allowed putting in the roof beams, but I am not allowed to cover it until it is on our Kocan. We have had to employ an architect for him to do the drawings, etc, submit them to different departments, and then a month ago, we received the permissions but still have to have the final approval (which I was told we have) but I still cant cover the roof until the planning people at Nicosia have drawn it on the plans and it is added to the Kocan, which was submitted to them 3 weeks ago.

We had a good builder and he told us not to cover anything until we had the final completion certificate, at the solicitors, from the council. We had everything measured twice before the completion certificate and it would have made a difference if we had changed the original design.
We were told that once this certificate was received then we could cover over the terraces whilst waiting for the Kocan. This we did and no problems

My neighbour has covered his terrace which comes right up to the boundary wall with a permanent tiled roof. He is a very difficult, arrogant man and I am sure he has not obtained planning permission. Who do I complain to?
