Does anyone know what the law here is for using a phone hands free?

My mate just been fined for having her phone in her lap and using the speaker phone?

Is there a prescedent for this?

Thanks!!!!

You should of course have the phone to your ear when driving, whilst smoking a cigarette with a baby on your lap with an indicator on for no apparent reason.

If you break any of those laws you get a fine.

Agreed with butterfly. I already got fined last year for talking without hands free while driving. Fine was like ~160TL

The crime was speaker phone, she had to play with the phone to put into speaker mode.
The only way round this is by blue tooth control, this is hands free.

What if she'd started the call whilst not driving and then only continued on speaker-phone?

But I guess they must have observed her in the fiddling stage.....

It most definitely should apply to everyone, but I fear it doesn't/won't. She had it on a proper stand away from the steering wheel, and hadn't touched it 5 minutes prior to being pulled over.mmthe reason they gave whilst issuing the fine, was that she COULD have touched it.

In your first post you said:
My mate just been fined for having her phone in her lap
Which version is correct?

Strange if she had not touched it, it was in her lap, in a stand did the policeman have his head in the window to see it.???

Think it was a random stop, it was in her lap, she put it in the stand as he approached, the car.

I think the learning point, is that only blue tooth is acceptable. I never knew that hands free speaker wasn't!!!

It is possible to set (most) 'phones to 'Auto-Answer', so that you don't need to touch anything at all to answer an incoming call, and you can employ this setting - I believe - whether you are using a bluetooth headset or Hands-free mode.

It seems likely to me, that the policeman wasn't fooled by your friend trying to surreptitiously place the 'phone on its stand, and assumed that she had been holding it lower down, on her lap, and may have 'dialled out', selected 'hands-free mode' or otherwise 'fiddled' with it while she was driving. - perhaps he saw her looking down at it while she was talking...

If the handset remained on a stand, or was positioned where I could not easily touch it, and was set to Auto-answer, then whether Bluetooth or 'speaker mode' was in use, then I would certainly argue the case that I wasn't breaking the Law. I think that your friend's case was not so clear cut.
