Leaving a house in a Will

This question, probably should be addressed to an Advocate: anyway I've been asked to see on the Forum if anyone knows the answer.

If you leave your property here in TRNC to a close member of your family, but not a spouse, and you die, does the person inheriting the property have to go down the PTP all over again, plus change of name on Title Deeds and all other Government papers. The two people concerned are Brits.

Originally left my place in a will to my son; to simplify matters I subsequently (in 2018) transferred ownership to him. This required him obtaining PTP and the issue of a new kocan in his name - this was all done by an advocat.

You should double check this with an Advocate - Naomi Mehmet and Partners do a small fixed fee general enquiry.

However, I believe if you inherit a property you do not have to go down the route of permission to purchase as you are not purchasing.
My understanding is that it would be transferred to you via the Probate Route - including the name change on the Title Deeds.
Please double check this though to be sure of the rules.

Thanks people, will pass this info on to person concerned. My own opinion was Advocate advice, as its an expensive mistake for the unwary.

BenjaminButton - if you get a definitive answer from an Advocate, please can you post that on the forum as I am sure this would be helpful to many.

I know of several people who have transferred deeds of a property to their next of kin and this could be a problem if something were to happen to the next of kin before them (not expected but it does happen).

It can also affect your residency if you sign over your property to next of kin - you won't have a Kocan to show for your residency application.

Thanks people, I'll pass all the info on to the person concerned and will report back if she decides to go any further. I have warned her that in the event of the property being "given" to her daughter and they fall out, she could lose her rights of tenure and left high and dry in KKTC. Unless Jofra can tell us otherwise of course. Thanks again.

Sorry; as "swallows" spending 2 x 6-7 weeks each year (none last year!), we have never had or applied for residency - if/when we get over next time, this we will have to discover ourselves! :-?
